Please read these Terms of Service ("Terms") carefully before using the Fireloop app ("the App"). By downloading, installing, or using Fireloop, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. About Fireloop

Fireloop is a free wildfire awareness app developed and operated by Cloak Communications LLC, based in Clifton, Colorado. The App provides real-time wildfire incident data sourced from official government agencies including the National Interagency Fire Center (NIFC/WFIGS) and InciWeb, air quality information from the U.S. EPA AirNow program, satellite smoke data from NOAA's Hazard Mapping System, wind data from the National Weather Service, and community-submitted sightings and reports near active fires. The App is provided free of charge with no in-app purchases.

2. Eligibility

You must be at least 13 years old to use Fireloop. By using the App, you represent that you meet this requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Not an Emergency Service

Fireloop is not an emergency service. Data displayed in the App — including fire locations, perimeters, air quality readings, and smoke coverage — is sourced from third-party government APIs and may be delayed, incomplete, or inaccurate. You must not rely solely on Fireloop to make evacuation decisions or emergency safety decisions. Always follow the instructions of local emergency management authorities, fire agencies, and law enforcement. In an emergency, call 911.

4. User Accounts

You may use basic features of the App without an account. An account is required to post sightings, comment, and access certain personalization features. Accounts are created using your email address and a one-time passcode. You are responsible for maintaining the security of your account and agree to notify us immediately at [email protected] if you suspect unauthorized access. We reserve the right to suspend or terminate your account if you violate these Terms.

5. User-Generated Content

Registered users may post sightings reporting fire, smoke, road blockages, or power outages, and may comment on sightings near active fires. By posting content, you represent that you are physically near the fire or area you are reporting on, that your report is truthful and accurate to the best of your knowledge, and that you have the right to share any photos you upload.

You agree not to post content that is false, misleading, or fabricated; that impersonates emergency services, government agencies, or other individuals; that contains hate speech, harassment, or threats; that is sexually explicit or graphic; that contains personal information of others without their consent; that promotes illegal activity; that infringes any third-party intellectual property rights; or that contains spam or promotional material.

By posting sightings, comments, or photos, you grant Cloak Communications LLC a non-exclusive, royalty-free, worldwide license to display, store, and distribute that content within the App. You retain ownership of your content. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful or inappropriate. You may delete your own sightings and comments at any time.

6. Prohibited Conduct

You agree not to use the App for any unlawful purpose, attempt to access or disrupt our servers or infrastructure, reverse engineer or decompile the App, use automated tools to access the App or its data, impersonate any person or entity, interfere with other users' use of the App, or use the App to spread false emergency information.

7. Data Sources and Attribution

Fire incident and perimeter data is sourced from the National Interagency Fire Center (NIFC/WFIGS) and is used under a Creative Commons Attribution 3.0 license. Air quality data is sourced from the U.S. EPA AirNow program. Smoke data is sourced from NOAA's Hazard Mapping System. Wind data is sourced from the National Weather Service. These agencies do not endorse Fireloop or Cloak Communications LLC.

8. Disclaimer of Warranties

The App and all data it displays are provided "as is" and "as available" without warranty of any kind. We do not warrant that fire, smoke, air quality, or wind data is accurate, complete, or up to date, that the App will be available without interruption or error, or that sightings or comments posted by other users are accurate or reliable. Use of the App during an active wildfire emergency is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Cloak Communications LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including but not limited to reliance on fire, air quality, or evacuation data displayed in the App.

10. Indemnification

You agree to indemnify and hold harmless Cloak Communications LLC and its officers, employees, and agents from any claims, damages, or expenses including reasonable legal fees arising from your use of the App, your content, or your violation of these Terms.

11. Intellectual Property

The Fireloop name, logo, design, and original software are the intellectual property of Cloak Communications LLC. You may not use them without our prior written consent. Government-sourced fire and weather data remains the property of the respective agencies.

12. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://fireloop.live/privacy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Colorado and the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the applicable courts of Colorado.
